Alabama

Cindy Kelly of Helena, Alabama received a jury duty summons in June, 2003 from the Circuit Court of Shelby County, Alabama.

Cindy would have gladly served, as she had done twice before in the past, but now, as a full-time mother to her young daughter, she did not want to leave her daughter who had never been in daycare nor had a babysitter.  Cindy had NO family in town who could help care for her daughter while she was away for jury duty, and it was extremely difficult for Cindy’s husband to take time off from work.

When Cindy respectfully requested to be excused for the above reasons,

the Circuit Clerk told Cindy flat-out NO!”

The Circuit Clerk then informed Cindy that she could try to state her case to the Judge on the day that she was to report for jury duty, but advised against it because the Judge would not hesitate to embarrass her in front of everyone!

The Circuit Clerk further warned that if Cindy brought her daughter to court when she spoke to the Judge, the Department of Human Resources would take her child away from her!!

After this unbelievably cruel threat, the Circuit Clerk had the nerve to say, “We’re not MONSTERS down here…(at the courthouse)”
